Terms of Service

Important: These Terms apply to the Site only. Use of Undetect products and services is governed by a separate written agreement (e.g., a Master Services Agreement and/or Order Form and DPA). If there is any conflict, the service agreement controls for service usage.

This document is provided as a template and should be reviewed by qualified counsel to ensure it matches your actual business practices.

1) Who may use the Site

You may use the Site only if you can form a binding contract with us and are not prohibited from doing so under applicable law. If you use the Site on behalf of an entity, you represent that you have authority to bind that entity.

2) Acceptable use

You agree not to:

  • use the Site in violation of any applicable law or regulation
  • attempt to gain unauthorized access to the Site or its systems
  • interfere with or disrupt the Site (including by introducing malware, scraping in a manner that impairs service, or abusing endpoints)
  • use the Site to transmit unlawful, infringing, defamatory, or harmful content
  • reverse engineer, decompile, or attempt to extract source code from the Site except where such restriction is prohibited by law

We may suspend or restrict access to the Site if we believe your use creates security risk, violates these Terms, or could harm us or others.

3) Intellectual property

The Site and its content (including text, graphics, logos, UI, design, and materials) are owned by Undetect or its licensors and are protected by intellectual property laws.

You may view and print pages for your internal business purposes. You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit the Site content without our prior written consent, except as permitted by law.

Trademarks: “Undetect”, product names, and associated marks are trademarks of Undetect or its licensors.

4) Submissions and feedback

If you submit feedback, ideas, or suggestions, you grant us the right to use them without restriction or compensation, and you represent you have the right to submit them.

If you submit information through forms, you agree it is accurate to the best of your knowledge and does not include sensitive personal data unless explicitly requested and provided through an approved channel.

5) No warranties

The Site is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

6) Limitation of liability

To the maximum extent permitted by law:

  • Undetect will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill arising from or related to your use of the Site.
  • Undetect’s total liability for any claim relating to the Site will not exceed EUR 100 (or the minimum amount permitted by law if a cap is not allowed).

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

The Site may contain links to third-party sites or services. We do not control and are not responsible for third-party content, policies, or practices. Access them at your own risk.

8) Privacy

Your use of the Site is also governed by our Privacy Policy. Please review it to understand how we collect and use personal data.

9) Changes to the Site or Terms

We may modify or discontinue the Site (in whole or part) at any time.

We may update these Terms from time to time. The updated Terms will be posted on the Site with a revised “Last updated” date. Your continued use of the Site after changes become effective constitutes acceptance of the updated Terms.

10) Governing law and jurisdiction (Estonia)

These Terms are governed by the laws of the Republic of Estonia, excluding conflict-of-law rules.

You agree that disputes arising out of or relating to these Terms or the Site will be subject to the exclusive jurisdiction of the courts located in Estonia, unless mandatory law provides otherwise.

11) Miscellaneous

  • Severability: If any provision is held unenforceable, the remaining provisions remain in effect.
  • No waiver: Failure to enforce a provision is not a waiver.
  • Assignment: You may not assign these Terms without our prior written consent; we may assign them as part of a corporate reorganization, merger, acquisition, or asset transfer.
  • Entire agreement: These Terms are the entire agreement between you and Undetect regarding the Site, and do not govern the products/services (which are covered by a separate agreement).
  • Language: If translated, the English version prevails to the extent permitted by law.
