Export Controls and Sanctions Compliance
Undetect (the “Company”) is based in Estonia and is committed to complying with applicable export control and sanctions laws, including (as applicable) the laws and regulations of the European Union and Estonia, and any other jurisdictions whose laws may apply to the provision or use of the Services (together, “Export Controls and Sanctions Laws”).
1) No Restricted Parties or Restricted Locations
You may not use, access, export, re-export, transfer, or otherwise make available the Services, Software, Documentation, or any related technical information (collectively, “Undetect Materials”), directly or indirectly, to or for the benefit of:
- any individual or entity that is listed on, or owned or controlled by a person listed on, any applicable sanctions or restricted parties list (a “Restricted Party”); or
- any country, territory, or region where dealing s are prohibited or materially restricted under applicable Export Controls and Sanctions Laws (a “Restricted Location”).
This restriction applies regardless of whether the transfer is direct or via intermediaries, including through resellers, contractors, affiliates, agents, or other third parties.
2) Prohibited End Uses
You may not use Undetect Materials, and may not permit any third party to use Undetect Materials, * *directly or indirectly**, for any end use that is prohibited or restricted under Export Controls and Sanctions Laws, including (without limitation):
- use by, for, or on behalf of any military, intelligence, defence, or security organisation, or for the development, operation, or enhancement of military or intelligence capabilities, unless you have obtained all required governmental authorisations and licences prior to such use; or
- any end use that would require a licence or authorisation under applicable Export Controls and Sanctions Laws where such licence or authorisation has not been obtained.
You are responsible for determining whether your intended end use requires a licence, permit, or other governmental authorisation, and for obtaining and maintaining any required approvals.
3) No Circumvention; No Indirect Supply
You must not take any action intended to evade, circumvent, or obscure compliance with Export Controls and Sanctions Laws, including by:
- masking your identity or location (e.g., via false registration details, proxies, VPNs, or other obfuscation methods);
- routing access through third parties to provide the Services to Restricted Parties or into Restricted Locations; or
- providing access credentials, API keys, integrations, or technical assistance in a manner that results in indirect supply to Restricted Parties, Restricted Locations, or prohibited end uses.
4) Re-Export and Transfer Controls
If you receive access to Undetect Materials, you must not export, re-export, transfer, disclose, or make them available to any third party (including your affiliates, contractors, or end customers) in violation of Export Controls and Sanctions Laws. This includes remote access and cross-border access to software, APIs, source code (if provided), and technical information.
5) Your Representations and Ongoing Duty to Notify
By using the Services, you represent and warrant that:
- you are not a Restricted Party and are not acting on behalf of, or for the benefit of, a Restricted Party;
- you are not located in a Restricted Location and will not access or use the Services from a Restricted Location; and
- you will comply with all applicable Export Controls and Sanctions Laws in connection with your use of the Services.
You must promptly notify the Company if any of these statements become inaccurate or if you become aware of any actual or suspected violation involving your account, users, or downstream recipients.
6) Compliance Checks; Suspension and Termination
The Company may request information reasonably necessary to verify compliance (including end-use or end-user information) and may suspend or terminate access to the Services if:
- such information is not provided in a timely manner;
- the Company reasonably believes continued access could violate Export Controls and Sanctions Laws; or
- required licences/authorisations are not in place.
7) Reporting
If you believe Undetect Materials have been provided to a Restricted Party, used in a Restricted Location, or used for a prohibited end use, you must promptly contact the Company and provide all relevant details so appropriate compliance steps can be taken.
